Summary of Rules and Regulations

Properties in Escoba Bay were conveyed to owners subject to certain protective covenants, conditions, restrictions, reservations, and charges identified in the Declaration of Master Covenants for the community. The document created an Association made up of the owners which was “assigned the powers of owning, maintaining and administering the community properties and facilities, administering and enforcing the covenants and restrictions, collecting and disbursing the assessments and charges hereinafter created, and promoting the recreation, health, safety, and welfare of the residents." It also made provision for an elected Board or Directors to manage the Association's business, charged it with responsibility for enforcing the land use restrictions in the document, and gave it the power to formulate, publish and enforce reasonable rules and regulations concerning the use and enjoyment of the Common Area Over the years various Boards or Directors have established and modified a number of rules and regulations relating to the above responsibilities. The purpose or this document is to summarize briefly those rules and regulations the current Board believes must be enforced to preserve the values and amenities of the Escoba Bay Community.

• Annual assessments are due on January 1 each year but may be paid in three installments, due on January 31, February 28, and March 31. If any installment is late the account is considered delinquent.
• Only owners and renters of property in Escoba Bay and their families and qualified guests shall have access to the community amenities (club house, swimming pool, boat storage lot, and boat ramp.)
• Owners who rent their houses to others relinquish their privileges to their tenants and shall not have access to the amenities.
• Delinquent owners shall not be eligible to use clubhouse, swimming pool, boat storage lot, or boat ramp.
• Renters whose owners are delinquent shall not have access to the amenities until the assessments are paid. Renters will be referred to the rental agents who manage the properties to resolve the problem.
• The clubhouse may be rented by owners and renters in good standing for their personal use or that of their families. Those renting the facility are responsible and must be in attendance throughout the event. A deposit of $200 is required in advance to reserve the facility of which $125 will be retuned if the clubhouse is clean and undamaged.
• The swimming Pool will normally be open from Memorial Day weekend to Labor Day weekend. Pool rules will be posted and monitors will be on hand during operating hours to ensure that they are enforced. Family members under the age of 14 must be accompanied by a responsible adult who is also a member of the immediate family. Teenagers cannot be responsible for those under 14 years of age. The pool monitors have the authority to eject from the pool area anyone who is ineligible to use the pool, violates the rules, or otherwise disrupts safe enjoyment of the facility by others. The pool monitors are not lifeguards or babysitters so parents are responsible for monitoring the activities of young children in and around the pool and in the bathhouse. Owners and renters are responsible for the conduct of family members and guests of all ages.
• Only resident owners can house horses in the stable facilities and only if space is available. No owner may house more than two horses. Stable facilities are not available to renters.
• Parking on the streets, sides of streets, other common areas, and unpaved surfaces on residential lots is not allowed. Violators will be warned but continued or repeated violations will result in vehicles being towed to storage facilities at owners' expense.
• Boats cannot be parked on residential lots for more than 72 hours, and trailers, campers, and large commercial vehicles are not allowed at any time. Storage in a community boat lot may be available as space allows, but each vehicle must first be registered with and authorized by the facilities manager. Resident owners have priority over renters. If space is not available in the storage lot, owners of such vehicles must seek storage outside the community.

• Keys to the boat lot, boat ramp, and swimming pool will be issued to each eligible owner or renter for a nominal deposit to be determined by the Board of Directors. The keys remain the property of the Association and are not to be copied, loaned to others, or passed on to purchasers of your property. Deposits will be refunded if and when keys are returned. Lost keys will result in forfeiture of deposits and additional deposits for replacements.
• Residents who wish to modify or enhance existing property in Escoba Bay must receive prior approval from the Associations architectural committee. This includes such things as tree removal, additions, fences, storage sheds, piers, bulkheads, modifications of existing decks, watering systems, etc. Information on requirements and approval forms are available in the business office.
• Since the Board is tasked by the covenants to see that the exterior of the community properties are maintained in a “reasonably neat and orderly” manner, we have established the following requirements:
1. Pressure washing- Any vacant or occupied dwelling unit maybe required to be pressure washed at least once (I time) per year to prevent the visible build-up of mold and mildew.
2. Lawn Maintenance - Any developed property (occupied or vacant) shall be mowed at a minimum of twice (2 times) per month during the growing season. Any vacant cleared lot (a lot that has been cleared from its natural state) shall be mowed a minimum of three (3) times between early spring and late fall (more often if deemed necessary by the Association). Lots are to be mowed out to the street.

In the event that a property is deemed by the Association to be in need of pressure washing, or mowing more frequently than the above minimums, a notice will be
sent to the resident or owner. If the required maintenance is not done within a reasonable time, the Association will have it done and bill the appropriate party the cost plus a service fee of 20 percent.
• Unattended and unsecured dogs have become a problem in Escoba Bay, in some cases a danger to children, the elderly, and their pets. Onslow County has a leash law that we try to enforce, but we cannot do without the cooperation of dog
owners and other residents who observe the violations. If you see a loose dog, please take its picture to document the violation and report it to animal control.
• Owners walking their dogs are requested as a common courtesy to other residents to carry a container and pick up their dogs’ droppings.
• Because of concern for the safety of our residents and property, shooting of guns is not allowed within or near the boundaries of Escoba Bay, including BB guns
and pellet guns.
Because we have not had a facilities manager to monitor the activities within Escoba Bay during the past several months, many or the above rules have not been properly enforced. We now have a new facilities manager and he has been tasked with bringing violations to the attention of the guilty parties and taking action to see that the required corrections are made. We believe it is necessary to do so to improve the appearance and preserve and
enhance the values and amenities of the community.
